FDIC coming up empty in pursuit of bankers

Like many banks engulfed by the mortgage crisis, First National Bank of Nevada specialized in risky home loans that didn't require borrowers to prove their incomes. When the housing bubble burst, First National got crushed in 2008 under the weight of bad loans that it could no longer resell to investors.

Last year, the Federal Deposit Insurance Corporation sued two former senior executives of the defunct bank for alleged negligence and breach of fiduciary duty, hoping to recover nearly $200 million in losses that it tied directly to those executives' decisions. The two men denied wrongdoing and settled for $40 million.

But they didn't pay a dime.

Instead, the federal agency ? which is better known as a regulator that seizes control of failing banks and provides deposit insurance for consumers than for its prosecutorial endeavors ? is still fighting in court to collect that money from Catlin Group Ltd., a Lloyd's insurance syndicate. Catlin provided an equivalent of malpractice insurance to First National's executives, but the insurer denied liability for the executives' alleged mistakes.

The case illustrates complex legal maneuvering as the FDIC steps up efforts to pick through the detritus of the financial crisis, and to recoup at least some of the nearly $87 billion costs to its deposit insurance fund from the collapse of about 400 federally insured banks between 2008 and late 2011. The First National Bank failure cost the fund $900 million.

Concerns about whether the FDIC's strategy isn't aggressive enough in such cases at least partly echo criticism levied at other regulators and enforcement agencies for being too lenient.

Over the past 18 months, the FDIC has filed 22 lawsuits targeting personal finances of former executives, their insurance policies, and sometimes their spouses' assets, in an attempt to claw back some of the money, and to deter reckless banking practices in the future.

Of the lawsuits filed so far, none has gone to trial yet, and three have been settled. A look at the three deals suggests the FDIC is prepared to accept a fraction of the alleged damages as a settlement while some former executives deny wrongdoing and escape significant financial responsibility for bank failures.

Avoiding costs
The primary targets of the lawsuits aren't so much the former executives' wallets, but rather the insurance policies most banks take out to shield their officers and directors from claims of negligent management, according to court documents and interviews with lawyers.

FDIC officials say their settlement strategy is driven by the need to maximize recoveries, and to avoid costs for potentially losing litigation. In response to questions, the FDIC says its "actions do send a message, and settlements do result in directors and officers being held accountable." The agency added, "the reason that we have not gone to trial on any of these cases yet is primarily attributable to the fact that we are still early in the crisis."

But some critics, including a prominent senator, have faulted the agency for settling for too little and for failing to set precedents that could deter bankers in the future.

"Their recoveries should be much greater, and they should never allow a CEO to walk away with the idea that crime pays," says William Black, who as litigation director for an agency later folded into the FDIC, filed many of the hundreds of government's lawsuits against executives resulting from the savings-and-loan crisis of the 1980s.

Founded in 1933 in response to the bank failures and savings losses of the Great Depression, the FDIC is just one of several regulatory agencies digging through the aftermath of the financial crisis. Unlike some other regulators, the FDIC is credited with spotting the mortgage bubble early on, and with warning banks about it. What's more, a bulk of subprime loans originated with lenders that weren't regulated by the FDIC.

'Beat the system'
Investigations into some of the bank failures on the FDIC's watch have only recently been completed or are about to be, auguring a greater number of lawsuits, agency officials and outside lawyers say.

As of mid-February, the federal agency had authorized litigation in connection with more than 27 failed banks, in addition to the 22 lawsuits already filed. Last year, the FDIC says it collected $240 million from professional liability claims, a figure that represents most of such collections by regulators so far in the aftermath of the financial crisis. Following the savings-and-loan crisis, banking regulators recovered about $1.3 billion in damages from former directors and officers, according to an estimate by Dechert, a Washington law firm.

The FDIC's biggest settlement so far targeted Washington Mutual. The FDIC sued several former executives, accusing them of gross negligence in pursuing high-risk lending that eventually caused the bank to lose billions of dollars and collapse in 2008. The FDIC sought $900 million in damages, but last December settled for $95 million, most of it covered out of insurance, with several executives contributing less than $500,000 between them.

The FDIC said the December settlement was "suitable" and provided "a significant return" while avoiding a costly court battle. But others criticized the deal. Sen. Carl Levin, whose subcommittee's investigation of the financial crisis included a scathing chapter on WaMu, said the settlement "shows again how bank executives can beat the system." The former executives denied wrongdoing.

In pursuing these claims, the FDIC acts more like a bankruptcy receiver whose main goal is to collect money, not punish executives. But with the dearth of criminal prosecutions in the aftermath of the financial crisis, the FDIC's liability claims carry a bigger weight. The Justice Department, for instance, closed its WaMu probe in August without any charges.

Ignored warnings
The FDIC says its lawsuits help improve banking practices and that its investigators have made criminal referrals in cases where they suspected outright fraud.

The First National case provides a window into these legal struggles.

Before it collapsed in 2008, the bank was part of a holding company that expanded through acquisitions and new ventures, mostly in Nevada and Arizona.

Though initially conservative in its lending outlook, First National got swept up in the residential-loan fever early last decade and billed itself in press releases as "Home of Alt-A lending", a category just a notch above subprime, according to court documents. First National was "extremely aggressive" and set aside normal caution and underwriting standards, according to the FDIC lawsuit filed in August in a federal court in Arizona.

When the housing market softened, First National's management ignored warnings from the bank's own employees and from government regulators pointing out the inherent risks of the lending strategy, the lawsuit says. In bringing its negligence case, the FDIC singled out Gary Dorris, the holding company's former CEO, and Philip Lamb, who was the executive vice president. The two "continued this downward spiral even after investors told them they would not purchase loans" the bank kept churning out, the complaint says.

In fact, Lehman Brothers, which itself eventually collapsed triggering the worst days of the financial crisis, rang alarm bells about the quality of First National's loans as early as 2007. In a lawsuit filed in an Arizona state court, Lehman alleged that the bank had sold it mortgages with numerous misrepresentations about the borrowers' finances, employment and the nature of the property. Lehman sought $18 million in damages.

First National denied the allegations and settled for an undisclosed amount. Jay Coleman, a lawyer who represented First National, declined to comment on the settlement, citing confidentiality issues.

Dorris and Lamb also denied wrongdoing in the FDIC lawsuit. The bank failed not because of any negligence on their part but because of "the unprecedented disruption of the real estate market," they said in a court filing. Ronald Glancz, a lawyer who represented them in the case, said they were unavailable for comment. "Everyone wants to put this behind them and get on with their lives," he said in an email.

But as part of a complex settlement, they agreed to a judgment of $20 million against each of them, a figure derived from "what a jury might reasonably award (the FDIC) as damages," according to a September court motion. As part of the same deal, federal regulators promised not to collect that money from the two former executives, and instead to go after Catlin, the Lloyd's syndicate.

Months before the lawsuit was filed, federal regulators held talks with lawyers for several former executives, including Dorris and Lamb. During those talks, the FDIC hammered out a deal that involved $3.5 million in penalties from two other executives and a $7 million payment from another insurer, Chubb Group, according to an FDIC court filing. The two other executives also signed consent orders with the Office of the Comptroller of the Currency banning them from working at federally-insured banks in the future.

But the FDIC targeted Dorris and Lamb for the lion's share of the damages. Shortly before First National collapsed, its Chubb insurance policy had expired. With its risk exposure growing, the bank had trouble finding another insurer, according to court documents. Eventually, the bank signed on with Catlin, in exchange for a steep premium that the executives assumed would cover claims of negligent conduct predating the start date of the policy, according to a lawsuit filed by the FDIC against Catlin.

When the insurer balked at settling those claims with banking regulators, the FDIC sued Dorris and Lamb, settled with them for $40 million, and then turned around and sued Catlin for that money. Dorris and Lamb didn't face banking bans or any other penalties.

In a court filing last month, Catlin denied liability, arguing that "coverage for the events in question (is) specifically excluded by the terms of the policy." The battle continues. A Catlin spokesman declined to comment further. In a written response to questions, the FDIC said the First National settlement is "a good example of directors and officers being held accountable."

The Americans will play an exhibition game against Spain on July 24 in Barcelona, their federations announced Friday.

The trip to Barcelona comes 20 years after the Dream Team, considered the best basketball ever, dominated Olympic play en route to a gold medal in the first games featuring NBA players.

The Americans are the reigning Olympic champions, beating Spain 118-107 four years ago in Beijing. It was their first title since 2000.

The U.S. will open its pre-Olympic schedule against Dominican Republic on July 12 in Las Vegas. The Americans will face Brazil in Washington on July 16 in a doubleheader with the women's teams, before facing Britain on July 19 in Manchester, England.

Pfizer says its drug is best hope for Alzheimer's (Reuters)

(Reuters) ? Pfizer Inc research chief Mikael Dolsten said the company's experimental treatment for Alzheimer's disease is the drug industry's "best chance" to delay progression of the memory-robbing illness.

Dolsten, speaking at the BIO CEO and investor conference in New York, stopped short of predicting whether the drug being developed with Johnson & Johnson would meet that goal.

"This is so far the best chance the industry has for disease modification in Alzheimer's," he said. Dolsten said Pfizer's drug, bapineuzumab, had far more complete and compelling data from already finished mid-stage clinical trials than Eli Lilly and Co's solanezumab.

Both companies plan to release Phase III data in the second half of this year from their respective large trials. The drugs are meant to be the first to slow progression of Alzheimer's, a disease that affects an estimated 5 million Americans and more than 35 million people worldwide.

"Bapineuzumab was the only one of these two that had significant Phase II data," Dolsten said, referring to the relatively brief 12-week trials Lilly conducted on solanezumab before moving it into large late-stage studies.

By contrast, Pfizer's Phase II studies of bapineuzumab lasted 18 months, better enabling Pfizer to pick appropriate doses of the medicine in far larger ongoing Phase III studies.

But mixed results were seen among patients receiving bapineuzumab in those smaller earlier studies. Patients in one mid-stage trial had an almost 25 percent lower accumulation in the brain of amyloid plaques -- a suspected cause of Alzheimer's disease -- than those receiving placebo injections. But they achieved no cognitive benefits. And patients receiving high doses of the Pfizer drug in another mid-stage study had worrisome brain swelling.

Asked in a recent interview if Lilly's short Phase II studies might hurt its drug's chance of succeeding in bigger Phase III trials, Dr. Eric Siemers, head of Lilly's Alzheimer's program, said, "The jury's still out; we don't know if it was the right choice."

But Siemers told Reuters the shorter trials enabled Lilly to get solanezumab into late-stage trials far more quickly and at far less expense, hopefully without compromising future results.

Many investors consider bapineuzumab and Lilly's rival injectable drug long shots because they treat patients that already have developed mild to moderate symptoms, such as memory loss and inability to perform daily chores, and therefore may have suffered irreversible damage to neurons and brain tissue.

Dolsten cautioned that Alzheimer's patients would probably need to be treated at earlier stages of the disease to produce the most beneficial results, a prospect he sees likely within the next five years.

Pfizer is counting on newer drugs to deliver revenue needed to offset plunging sales of its Lipitor cholesterol fighter, which has faced cheaper generics since November.

They include Prevnar 13, an improved form of its Prevnar vaccine to prevent infections with streptococcus bacteria. The U.S. Food and Drug Administration in December approved its use for adults aged 50 and older, greatly widening the market for the product, which had been approved only in children.

Dolsten said Pfizer expects data by next year from late-stage trials testing whether Prevnar 13 prevents pneumonia in adults. The $3.3 billion-a-year vaccine could get a big commercial boost if the trials succeed, especially in preventing

pneumonia among the elderly, he said.

The world's biggest drugmaker also has high hopes for tofacitinib, an experimental pill that treats rheumatoid arthritis through a new approach and is awaiting U.S. approval.

The FDA is slated to decide on tofacitinib by August, but Dolsten said an FDA advisory panel of outside experts is likely to weigh the drug's safety and effectiveness beforehand.

"We expect a dialogue about how this drug will be used," Dolsten said, given its new mechanism of action. It is the first in an emerging class of drugs known as JAK inhibitors that block a protein associated with inflammation.

The research chief also expressed confidence Pfizer will eventually develop an anti-smoking vaccine and important new treatments for cardiovascular disease and diabetes.

Last year, Pfizer said it would slash its annual research budget by as much as $2 billion in order to deliver on earnings goals.

Dolsten on Tuesday said Pfizer wants to remain a research leader but will likely increasingly team up with other drugmakers, and rely more heavily on contract research organizations (CROs) to conduct its large late-stage trials.

Increasing numbers of those trials will be conducted in distant emerging markets. But Dolsten said safeguards will ensure that outside contractors do not cut corners, and thereby sacrifice quality controls in order to deliver speedy results.

Raspberry mousse recipe

Ingredients: 1 pint cream, 3/4 cup sugar, 1 cup sieved raspberries, 1 tablespoonful lemon juice.

Wash and put the berries through a sieve. Stir in the sugar and lemon juice if desired; then fold in the whipped cream. Place in a mold and bury in ice and freezing salt for two hours. Serve with a garnish of raspberries and whipped cream. An apricot, strawberry or peach mousse made in the same way will be equally delicious. If a large mold of mousse is made allow from three to four hours for freezing.

Your fireless cooker or a large icebox is an excellent place to put the mousse and ice during the freezing, for if left where the ice will melt rapidly it must be drained and repacked. This should be done when the ice begins to float on the surface of the water, for after that the temperature will begin to rise.

Ingredients:?1 cup sugar, 2 cups of double cream, 1/2 cup boiling water, 2 or 3 teaspoonfuls vanilla, 2 egg whites

Boil the sugar and water?to?238 degrees F?(until it threads) and pour?it in a fine?stream?over the stiffly-beaten egg whites. Beat constantly until cold, then flavor and fold in the whipped cream. Pack and freeze as a mousse.

This the French flavor with wine instead of vanilla, mold in a tall, slender peak and serve as ?Dame Blanche.? (Of historic interest rather than practical value.)

Half a cup (about four) stale macaroons crushed to a powder, or half a cup of maraschino cherries, chopped, or both, may replace the vanilla in the angel parfait. Garnish with macaroons, cherries and whipped cream in serving.

Packing the molds

First, be sure that the cover fits tightly. A wise precaution is to fill the mold very full, then a layer of waxed paper (or even a buttered one with buttered side up) over the top; put on the cover and let some of the mixture be forced down the sides. Bury this in ice and salt. The proportion of ice and salt differs from that used for ice cream, as the texture sought is different. The larger the proportion of ice the finer will be the texture (and the longer to freeze). So instead of the three to one used for the ice cream, use four parts ice to one part salt for a mousse.

Frozen bombes

The Lisbon Summer School 2012 has as its topic the contentious relationship between religion and politics, and the impact that this relationship has on gender issues. Religion undoubtedly plays an important role in contemporary societies: multiculturalism, migration and bioethical debates, among others, put religion in the spotlight, thereby calling for a redefinition of classical secularization theories. Today, the separation between religion and politics is being questioned more or less radically, as is the meaning and the substance of democracy. At the same time, European as well as non-European societies are experiencing a profound reshaping of their political landscapes. The Mediterranean area is especially affected by massive transformations ? as can be seen in phenomena like the ?Arab Spring? or the Spanish ?indignados??movement.

In these contexts, it has become clear that new modes of governance redraw the boundaries between? institutional actors and citizens, and create space for horizontal networks. Gender relations lie at the heart of these transformative processes. In Europe, gender relations have over the last 20 years become the focal point of controversies over the contested separation of religion and politics ? the various ?Hijab affairs? in many European countries attest to this fact.

This broad theme will be discussed on the three days of the summer school along the following lines:
1. We will look into contemporary configurations of secular regimes from a comparative and historical perspective.
2. We will scrutinize the manifold and complex ways in which gender is affected by, and at the same time itself affects, modes of religious governance in modern societies.
3. We will focus on the democratic challenges and opportunities that religious diversity creates within liberal political regimes.

The topic of this summer school is by definition interdisciplinary. Grasping the complex interface between religion and politics, and how they it impacts on gender and gender relations involves different disciplines, such as Political Science and Sociology, Gender Studies, Philosophy, Anthropology, Religious Studies and Theology. Each of these disciplines can offer original and in-depth insights into the topic of this summer school. Therefore, researchers and practitioners working in these academic fields are invited to apply. Both theoretical papers on the normative and conceptual problems, and empirical papers on case studies, comparative accounts, and historical trajectories are welcome.

In terms of teaching methodology, this summer school is based on the idea that only a productive dialogue between the faculty and the participants can promote the flourishing of democratic scholarship. Therefore, each of the three days of the summer school will consist of a morning session, with interactive presentations by the faculty, and of an afternoon session, featuring the individual presentations of the participants. Participants will hence have the unique opportunity to engage in critical conversations with the faculty, and discuss their own research projects. Faculty members will present original contributions to the topic as well as comment on the participants? papers.

How to Apply? To participate in the summer school you must have at least completed a BA degree. Interested graduate students and postdoctoral researchers should go to the website and fill in the form there.

Travolta, Sandler, more make Super Bowl picks (AP)

INDIANAPOLIS ? John Travolta not only knows who's going to win the Super Bowl, but by how much.

The movie star had this prediction when asked for a winner of the battle between the New England Patriots and the New York Giants: "37-34, Giants."

He wasn't the only celebrity making predictions. Nick Cannon and Danny DeVito both picked the Giants, while Adam Sandler felt the Patriots had the edge (though he was admirer of the Giants Victor Cruz's salsa dance: "I like watching him do it," he said).

Donnie Wahlberg spent time besides the Patriots bench just before kickoff. Asked who he thought was going to win, he said: "The Patriots. I know it."

The Boston-area native said he was partying with the Patriots after the game ? "win or lose."
